This Disclaimer applies to everything made available by Only Punts Pty Ltd (ABN 15 676 004 363) (“Only Punts”, “we”, “us” or “our”) through onlypunts.au, our mobile and web application, our emails, our Discord community and our social media channels (together, the “Services”). It forms part of our Terms and Conditions.

 

All information provided through the Services is general information only. We take reasonable care to keep it accurate and current, but we make no representation or warranty of any kind, express or implied, about the accuracy, completeness, reliability, availability or suitability of any information, and we do not update information that has already been published.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONLY PUNTS IS NOT LIABLE FOR ANY LOSS OR DAMAGE OF ANY KIND ARISING FROM YOUR USE OF, OR RELIANCE ON, THE SERVICES OR ANY INFORMATION MADE AVAILABLE THROUGH THEM. ANY RELIANCE YOU PLACE ON THAT INFORMATION IS AT YOUR OWN RISK.

 

WHAT ONLY PUNTS PROVIDES

Only Punts provides two kinds of racing information. The first is tips, ratings and insights generated automatically by our algorithmic and statistical selection model from racing form and historical data (“App Outputs”). The second is selections, written analysis, suggested staking and other content prepared by our team from their own research and experience (“Selections”), delivered by email and in our Discord community. Selections are prepared independently of the App.

Only Punts is not a bookmaker, wagering operator or gambling service. We do not accept bets, hold betting funds or place bets for anyone. We are not licensed financial advisers, and nothing we provide is financial advice, betting advice or a personal recommendation. Selections and App Outputs are general information and opinion prepared without regard to your personal circumstances. When you pay for a membership you are buying access to information, research and a community for a period, not a betting outcome or financial return.

 

SELECTIONS AND APP OUTPUTS ARE OPINIONS AND ESTIMATES

Each Selection is an opinion formed in good faith about a horse we believe represents a good opportunity, based on research of racing data. Each App Output is a probabilistic estimate produced by a model. Neither is a prediction of what will happen, a promise or a guarantee. Horse racing is inherently uncertain. Horses, jockeys, tracks, weather and markets are unpredictable, and many Selections and App Outputs will not win. Some weeks, months and longer periods will lose money overall.

Selections and App Outputs are based on the information available when they are published. They may be affected by late scratchings, jockey, gear or barrier changes, track downgrades, weather, market movements or other information that emerges afterwards, and we may change or withdraw a Selection without being able to notify you in time. Always check the final field and conditions before you bet.

 

LABELS, UNITS AND STAKING GUIDANCE

We sometimes attach a label to a Selection (such as Bomb, or a label indicating our highest confidence) and suggest a stake expressed in units. A label describes our level of confidence in that Selection relative to our other Selections on the day. It does not mean the horse is likely or certain to win, and no label should be read as a guarantee.

A unit is a fixed fraction of a betting bank that you set for yourself. Suggested stakes, betting bank approaches, insurance or danger runners and any strategy of following a Selection in its later starts are general guidance about one way to manage risk. They are not tailored to your income, savings or circumstances and are not a direction to bet. You decide whether to bet, how much to bet, at what odds and with which bookmaker, and you should never increase your stakes to chase a loss.

RESULTS, STRIKE RATES AND PAST PERFORMANCE

Where we publish results, strike rates, units won or lost or similar figures, they are calculated from our own records of the Selections we track, using the odds and suggested stake stated when each Selection was published and the bookmaker nominated in that Selection. Where a figure is calculated on a different basis (for example, a strike rate measured over a horse’s next several starts), we state that basis alongside the figure. We keep the records behind our published figures and you may ask us how any figure was calculated.

PAST PERFORMANCE IS NOT A RELIABLE INDICATOR OF FUTURE PERFORMANCE. WE DO NOT GUARANTEE THAT ANY PAST RESULT, STRIKE RATE OR RETURN WILL CONTINUE, AND WE DO NOT GUARANTEE THAT YOU WILL MAKE MONEY. YOU MAY LOSE SOME OR ALL OF THE MONEY YOU BET.

Examples of past Selections or results published on the Services, in our marketing or on social media are illustrative only and are not representative of the results any particular member should expect.

 

ODDS, BOOKMAKERS AND YOUR OWN RESULTS

Your results will differ from our published results. Odds move quickly once a Selection is published, and we cannot guarantee that the odds quoted with a Selection will be available to you. The bookmaker you use, the time you place your bet, the stake you choose, bet limits and account restrictions imposed by bookmakers, deductions for scratchings, market fluctuations, and whether you follow all, some or none of our Selections will all affect your outcome. Results vary significantly between members, and no member should expect to match our recorded results.

DELIVERY, CHANGES AND AVAILABILITY

Selections are delivered by email and through our Discord community, and App Outputs through the App. Delivery depends on email providers, Discord, app stores, internet connections and other services outside our control. Technical faults, outages, delayed or missed notifications and platform changes may delay or prevent delivery, and we are not responsible for a Selection or App Output you did not receive or saw late. We do not guarantee a minimum number of Selections in any period, and we may vary the days on which Selections are provided.

 

RESPONSIBLE GAMBLING

Gambling involves real financial risk. Only ever bet with money you can afford to lose, set limits and stick to them, never chase losses, and never bet because you feel pressured to follow a group. Gambling is not a way to earn an income and you should not rely on our Services, or on gambling, to pay living expenses or debts. The Services are only for people aged 18 or over who are legally permitted to gamble where they live.

You can exclude yourself from all Australian licensed online wagering providers through BetStop, the national register for excluding yourself from online wagering, at betstop.gov.au. If you tell us gambling is causing you harm, we will cancel your membership and refund any unused prepaid period.

The Services may contain links to websites, apps and services of third parties, including licensed wagering operators, form guides, data providers and Discord. We do not control, monitor or verify their content or services and accept no responsibility for them. Any dealings you have with a third party, including any wagering account or transaction, are between you and that third party.

Some links are affiliate links. If you follow an affiliate link and sign up, deposit or bet with that partner, Only Punts may receive a commission or referral payment at no extra cost to you. We only link to wagering operators licensed in Australia, and we do not offer inducements to open a betting account or to bet. Our current affiliate partners are listed on the Services and may change from time to time.

WE DO NOT WARRANT, ENDORSE OR GUARANTEE ANY CONTENT, PRODUCT OR SERVICE OFFERED BY A THIRD PARTY LINKED TO OR FROM THE SERVICES, INCLUDING ANY WAGERING OPERATOR.

The Services and our marketing may feature testimonials, reviews or screenshots of results from members. These reflect the individual experiences and opinions of the people who provided them, are not independently verified unless we say so, and are not representative of the experience of all members. Where a testimonial is edited, it is only to correct obvious errors or to shorten it. If a person providing a testimonial or promoting the Services has received a payment, incentive or free membership, we say so. You should not assume that you will achieve similar results.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONLY PUNTS AND ITS DIRECTORS, EMPLOYEES AND CONTRACTORS EXCLUDE ALL LIABILITY FOR ANY LOSS, DAMAGE OR OTHER CONSEQUENCE, FINANCIAL OR OTHERWISE, ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICES, INCLUDING ANY BET YOU PLACE, ANY STAKE YOU CHOOSE AND ANY DECISION YOU MAKE BASED ON A SELECTION, STAKING GUIDANCE OR AN APP OUTPUT. YOU ARE NOT ENTITLED TO COMPENSATION BECAUSE A SELECTION OR APP OUTPUT LOSES OR PERFORMS DIFFERENTLY FROM WHAT WAS EXPECTED.

Nothing in this Disclaimer excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified. Your contract for the Services is with Only Punts Pty Ltd. Selections and other content are provided by the company through its personnel, who are not personally liable to you for content provided in good faith on the company’s behalf.
